The National Markets and Competition Commission Report on the Resolution that Rejects the Request for a New Grant of General Licenses for Online Gambling

SPAIN (October 5, 2021) — The National Markets and Competition Commission (CNMC) has issued a report on the Resolution of the Directorate-General for the Regulation of Gambling, by which it is agreed not to proceed with the promotion of the call for a new procedure for granting general licenses for online gambling, requested by the complaining entity.

The CNMC considers that there are reasons of general interest that justify the denial of the application, such as the protection of consumers and the prevention of fraud and the incitement of citizens to excessive spending at stake.

Report of the plenary session of the CNMC board of September 15, 2021 on the claim presented, under article 26 of law 20/2013, of December 9, on the guarantee of the market unit, against a resolution of the general directorate for the order of the game of 26 of July 2021, whereas it is agreed not to promote the call for a new procedure for granting general licenses for online gaming requested by the claiming entity

By means of a document presented on August 26, 2021 in the General Registry of the Ministry of Affairs Economics and Digital Transformation, a claim was filed under article 26 LGUM against the Resolution of the General Directorate for the Regulation of Gambling of July 26, 2021, by which it is agreed not proceed to the promotion of the call for a new procedure for granting general licenses for online gambling, requested by the complaining entity.

In its Report, the CNMC considers that there are overriding reasons of general interest that justify the denial of the request to promote the call for the granting of general online gambling licenses, such as consumer protection and the prevention of fraud and incitement of citizens to overspending on the game, as shown in the fourth foundation of the Resolution itself that is the subject of the claim.
