NORTH CAROLINA (December 13, 2023) — Summary and Recommendations Regarding Public Comments Received in Response to Notice of Proposed Rulemaking of November 7, 2023
Rulemaking Package 1
On November 16, 2023, the Commission unanimously adopted Rulemaking Package #1, with Committee amendments and staff recommended changes, after receiving valuable feedback from the public and stakeholders through the Commissions expedited rulemaking process. In accordance with House Bill 347, the rules do not take effect until January 8, 2024. Please be advised that Rulemaking Package #2 proposed additional changes to rules in Rulemaking Package #1.

Rulemaking Package 2
During a public meeting on November 7, 2023, the Sports Betting Committee of the North Carolina State Lottery Commission approved commencing the rulemaking process on the second set of wagering rules and issued Notice of Proposed Rulemaking. The Commission accepted public comments regarding these rules from November 7, 2023 through November 27, 2023 and held a public hearing on November 20, 2023.
On December 6, 2023, the Sports Betting Committee voted to recommend that the Commission adopt Rulemaking Package #2 with staff recommended changes in response to the comments received during the public comment period.
On December 13, 2023, the Commission unanimously adopted Rulemaking Package #2 with the staff recommended changes identified in a summary memo and as discussed in the Commission meeting. In accordance with House Bill 347, the rules do not take effect until January 8, 2024. The Commission will have a final version of these adopted rules for publication in its Rules Manual for Sports Wagering and Pari-Mutuel Wagering when the rules are ready for codification. Until then, a working copy subject to technical corrections and further refinement by Commission staff will be available soon.
