PUBLIC CALL NO. 02-DL/2024/GC-S

FOR THE SUBMITTING BIDS FOR AWARDING A CONTRACT FOR A BUSINESS COOPERATION FOR THE SECURING OF A LEASE FOR GAME CONTENT AND PROVIDING SERVICES AND SUPPORT FOR VIDEO LOTTERY TERMINALS

SUBJECT OF THE PUBLIC CALL

In accordance with the Rulebook on the conditions, method and procedure for concluding an agreement for lease of game content and providing service and support for video lottery terminals registered by archive number 02-8785/03 of 29.12.2023, the Joint stock company for the organization games of chance, National Lottery of the Republic of North Macedonia, is making a Public call for submitting bids for awarding a contract for business cooperation for the securing of a lease for game content and providing services and support for video lottery terminals.

The share Joint stock company for the organization games of chance, National Lottery of the Republic of North Macedonia (National lottery) IS CALLING UPON ALL INTERESTED DOMESTIC AND FOREIGN LEGAL ENTITIES to deliver an offer for cooperation and the implementation of various game content for video lottery terminals, as well as securing service and support for them.

The contract for a business cooperation for the above-mentioned services is made by the National lottery with domestic and foreign legal entities (in the following text: business associates), under conditions which have been stated in accordance to the public call, for the completion of these matters and services:

Matters and services related to the securing services for lease of game content for video lottery terminals (in the following will be mentioned as VLT)
Matters and services pertaining to procuring a full service and support, technical support onsite, as well as procuring free spare parts for the VLT machines.

All interested bidders can deliver a full offer for a lease of game contents for video lottery terminals and the securing of full and complete service and support, technical support onsite, as well as securing free spare parts for the VLT machines, to take part in one or more points in this public call, this pertains to the following type of VLT machines:

VLT machine type 1;
VLT machine type 2;
VLT machine type 3;

The name of the VLT devices of the above-mentioned type is specified in the technical specification, which is an integral part of this Public Call.

The most optimal bidder will be able to sign a contract for the part of the offer where they applied.

The chosen bidder who has made an offer about one or more parts of the abovementioned types of VLT machines will have to cooperate with the Business associate with whom the National lottery has signed a contract for business cooperation and for the purchase of video lottery terminals for the organization of games of chance, or video lottery, in agreement to the above mentioned VLT machines, and through which the game content will be implemented or integrated and which will also possess a service and support of these machines.

2. CONDITIONS FOR SIGNING OF CONTRACTS FOR THE BUSSINESS COOPERATION OF SECURING SERVICES FOR THE LEASE OF GAME CONTENT FOR VLT MACHINES, AS WELL AS THEIR SERVICE AND SUPPORT (02-DL/2024/GC–S)

For a bidder to be able to take part in the choice of a business associate and having a contract for business cooperation for matters and services connected to the procurement of the lease of game content for video lottery terminals and their full service and support, technical support onsite, as well as the procurement of free spare parts for these VLT machines, it is necessary that the following conditions are met:

3.1 GENERAL CONDITIONS

To take part in the public call, the interested bidders must prove that they are capable for procuring the required service, with delivering documents for:

Personal state
Technical and professional capabilities
Standard systems of quality
Ownership or authorization for handling the object they lease

3.1.1. Documentation for validating personal state

Certificate for the competent trade registry;
Declaration of the bidder that he/she has not received a juridical conviction for taking part in a criminal organization, corruption, fraud or money- laundering;
Confirmation that a procedure for bankruptcy has not been started by a competent authority;
Confirmation that a procedure of liquidation has not been started by a competent authority;
Confirmation of paid taxes and contributions and other public fees by a competent authority originating in the country where the bidder is registered as resident;
Confirmation from a registry of penalties for committing offences to juridical persons, that they have not received a minor punishment, do not have a ban against taking part in public call actions, assigning contracts for public acquisitions and contracts for public and private partnerships;
Confirmation from the Registry of penalties for committed penalties to juridical persons, that they have not received minor fines, or temporary or long- term bans of inquiring certain activities.
Confirmation that they have not received an infringement-ban by a juridical verdict for pursuing a profession, activity or duty, respectively a temporary ban for entertaining a certain activity.

The documents must not be older than six months of the day of the deliverance of the offer counting backwards, and they are delivered in original or copy certificates by the bidder. If the contracting authority has doubts in the documents for the confirmation of the personal state, he keeps the right to ask for information directly from the competent organs which have issued the documents for the confirmation of the personal state.

In case of the country where the bidder is registered is not able to provide the above-mentioned documents, or if they do not cover all the cases mentioned, the bidder can give a statement which is legalized by a competent organ, or an authorized persons’ statement for the bidder, that the country does not possess such an institution able to give the abovementioned documents, and in which statement the documents will be named.

3.1.2. Document for confirming technical and professional capabilities

For the confirmation of the capability for performing professional actions for this part, the bidder should have a document in possession confirming the registered activity as evidence that he/she is registered as a physical or juridical person for performing activities related to the subject of the agreement or contract for public acquisition or evidence that they belong to a proper professional association in the country where they are registered.

3.1.3. Documents for the verification of the systems of quality for which the bidder is certified

The bidder is obligated to hand out documents which will serve as evidence that they possess standards of quality necessary for their cooperation in accordance to the legal regulations in the country of registry and the Republic of North Macedonia with the existing international standards of ISO 27001.

3.1.4. Documents for the verification of ownership or authorization for the management of the leased object

The bidder is obligated to submit a statement which confirms that they own the right of ownership, respectively the right to manage with services that they offer and that are a subject in the public call.

The offer of a legal entity will not be reviewed in case it is confirmed that in any circumstance has unpaid obligations to the National Lottery of the Republic of North Macedonia.

SPECIAL CONDITIONS

In order to take part in the public call, the interested bidder must fulfill the following terms and conditions:

To have at least one current client, regardless if the client is mainly in state or private ownership, and whom they supply with product or/and services in a legally implemented procedure in the domain of game content for games of chance, including the final technological platform and services on operational support and/or for a period of at least six months.
To complete services of point one on a regulated market in Europe or North America;
To enable usage of the abovementioned services for playing with real monetary means;
To secure a professional long-term maintenance and servicing of the VLT machines in accordance to the recommendations of the manufacturer/ supplier of the VLT products of DLM.
To secure a professional and trained personnel for completing the surface of at least 5 persons;
To have available at least 3 automobiles at their disposal and logistics and technical support in the locations which are used for organization in the whole Republic of North Macedonia;
That spare parts for the VLT machines of the National lottery will be in stock according to the recommendations of the manufacturer/ supplier of these machines in the National lottery;
To procure a telephone and technical support in the sales spots in which the National lottery has VLT machines put up;
To secure training for the staff in the sales spots in which the National lottery has VLT machines put up.

The confirmation of the special conditions of point 1 and 2 is made with presenting a reference list of active clients for whom the abovementioned conditions are carried out, and signed by the person responsible to the bidder.

The confirmation of the special conditions of points 3,4,5,6,7,8, and 9 are made with issuing a statement where the bidder states that is able to provide the required conditions signed by the person responsible to the bidder.

Except for the abovementioned conditions, the Bidder must fully fulfill/ provide all the required specifications quoted in the technical documentation which is annexed and a component part in the public call.

The national lottery requires that the software, the technology or services, rather the gaming contents which are the subject in this public call is to already be in the operational European domain of gaming contents of games of chance, with the exception of new, improved and innovational equivalent of models or newly launched games. The National lottery will not revise or accept the main items of configuration which are in specification or conceptual phase, early in their development or the products are only announced, but are not engineer ready for manufacturing and delivery.

GUARANTEE FOR PARTICIPATION

With the offer, the bidder submits a statement about the seriousness of the offer.

With the statement, the bidder declares that:

will not withdraw its offer before the expiration of its validity period,
will accept the correction of arithmetic errors by the commission,
will sign the business cooperation agreement in accordance with the terms of the public call, the tender documentation and the submitted offer or
will provide the guarantee for quality and timely execution of the contract, if the contracting authority has foreseen it in the public call.

MANNER AND TIME LIMIT OF THE DELIVERY AND VALIDITY OF THE OFFER

The offer for issuing an agreement of contract for business cooperation for service and securing a lease of game content for VLT machines and their full service and support, technical support onsite, as well as securing free spare parts for these machines, should be made in written form, in one original sample, sent through mail or delivery to the archive of the National lottery.

The address for the delivery of offers is boul. Goce Delcev no. 8,1000 Skopje, Republic of North Macedonia.

The procedure of signing a contract for business cooperation is preceded by the Commission for signing contracts for business cooperations.

The time limit of the validity of the offers is six months starting from the day of the offers’ delivery. Respecting the time limit is obligative.

The offer in a special closed envelope and other documentations are sent in a closed envelope with a written “DO NOT OPEN” note, and with the remittance “For public call for business cooperation 02-DL/2024/GC-S FOR VLT MACHINE TYPE 1, FOR VLT MACHINE TYPE 2 or VLT MACHINE TYPE 3” depending for which type of machine the bidder is making an offer.
The offer is delivered in one original sample, which is to be certifies and signed by an authorized person linked to the bidder.
The bidders who have not sent complete and valid documentation, are immediately excluded from the process and their offers will not be taken into consideration.
The offer, and all its added documents are to be delivered in Macedonian. The documentation delivered in English must also contain an official Macedonian translation of the same.
As an exception to this rule, the technical documentation, or the confirmation of the required technical specifications can only be written in English.

The final date for delivering the offers is 05.03.2024 till 11:00 o’clock.

The required documents which are in English language must be translated in Macedonian language by an authorized translator.

In case there are multiple offers which meet the required criteria of the mentioned public call and valid bidding documentation, then the authorized commission will approve of the bids which have been submitted first.

The bids which have arrived are opened without the bidders being present.

The Commission, before approaching the consideration and estimation of the offers, checks the completion and validity of the documentation beforehand.

The bidders who have sent an incomplete and invalidated documentation are excluded from the procedure and their offers will not be taken into consideration.

During the evaluation of the offers, the Commission checks their content, acceptability, correctness and appropriation.

The incorrect, inappropriate and inacceptable offers are denied by the Commission, and the bidders are notified of this.

A protocol is written during the meeting.

The protocol is signed by all the members of the Commission.

CRITERIA AND DECISION FOR GRANTING A CONTRACT

The Criteria for choosing the best offer for securing full technical and technological support with the lease of gaming contents for the network of video lottery terminals, as well as full service and support of these video lottery terminals is the lowest offer of percentage amount in the difference between the payments and payoffs of the means of the participants in the game of chance, and after the deducted means towards the Republic of North Macedonia in accordance to the legal basis where the compensation cannot be more than 19%.

The amount costs for a full service and support, technical support onsite, as well as securing free spare parts for the VLT machines is fixed and amounts to 1 euro per VLT machine part for the full duration of the agreement.

The decision for choosing the most favorable offer according to the proposition of the Commission in charge, is made by the General director of the National Lottery.

The unsatisfied participant from the public call can state an objection against this decision in a time limit of 8 (eight) days from the day of the delivery of the notification for the selection.

The objection is delivered in written form through the Commission which has led the case, to the Board of directors of the National lottery.

The decision of the Board of directors of the State lottery in the procedure for making contracts for business cooperation with the National lottery is final.

After the finalization of the of the decision for fulfilling the conditions for business cooperation, the chosen participant in the public call is bound to reach an agreement for business cooperation in the time limitation of 15 days starting from the day of delivering the Decision.

RIGHTS AND OBLIGATIONS OF THE CONTRACTING PARTIES

The rights and obligations of the business associate will be defined in detail in the Contract for business cooperation.

The business associate is obligated to put their merchandise and/or favors in use to the Contract for business cooperation of the ordering partner – the National lottery.

The business associate is obligated to give out the subject in lease and in a state of business readiness, in agreement with the National lottery.

The business associate is obligated to put the subject that they lease in a correct state and with written reference manuals for the manner of usage and the manner of maintenance in case of a defect, disaster and the like.

The business associate is obligated to put in disposition all the updated software and server, and the game library to the National lottery, by regularly adding new games (out of the approved games) in the Republic of North Macedonia for playing in the VLT machines from the accessible portfolio of games of the Business Associate, and with which there will be no added special fee to the National Lottery.

The business associate is obligated to secure support of the object that they lease.

The business associate is obligated to secure a full service and support, technical support onsite, as well as secure free spare parts for VLT machines in ownership of the state lottery.

The business associate is also obligated to organize and secure the needed human and other necessary resources in order to complete a quality service, depending of the number and territorial layout of the VLT machines.

The business associate must secure and own a necessary amount of spare parts for the VLT machines in stock, which is defined in agreement with the National lottery and the recommendations of the manufacturer of the equipment.

The business associate is obligated to do maintenance and remove obstructions onsite. It that is not possible, the business associate must organize the transportation, mending and returning of the machine on the sales spot at their own expense.

The business associate is obligated to start with the removal of the obstructions/ defects in the order of priority defects/ obstructions in a proper time manner, but within 48/72/96 hours, depending on the roads/ distance according to the defined list that comes with the written Contract. Having this in mind, the time in which the terminal are not in function should be minimized, and this will be regulated with a mutually signed protocol/ annex.

In case the defects of the VLT machines have emerged from the improper use of hardware, the business associate is not obligated to replace parts without compensation. In that case, the national lottery decides to engage the business associate based on a special delivered offer.

The obligation for free replacement of parts or other reparations will not be required in the following cases:

Natural disaster, vandalism, damage from fire, lightning strike, vermin.
Absence of electrical supply, data cables and the like.
Above average air pollution, heat and/or humidity.
Installation, configuration and/or support made by unauthorized personnel.
Unprofessional use of hardware.
Hardware handling by unauthorized persons.

The business associate is obligated to train the personnel handling the VLT, for undertaking simplified maintenance activities.

Rights and obligations of the National lottery

The National lottery has the right to chose a mixture of games for playing in the VLT machines, to ask for addition of new games and updating the ones that exist without any additional fee, for the time being of the Contract for business cooperation.

The National lottery has the right to a full service and support, technical support onsite and the securing of spare parts for the VLT machines in its ownership.

The National lottery is allowed to acquire check-ups and intervening if it evaluated that there is a validated need to do so.

In case of market or other variations and changes which result in an inevitable need to change the amount of compensation, as with the other conditions in settling a contract for business cooperation, this is also determined in the Contract for business cooperation. In the case that the business associate does not accept the new conditions for business cooperation, the contract is annulled, and for which the associate is to make a payment for damages.

DURATION AND GUARANTEE FOR A QUALITY COMPLETION OF THE CONTRACT

The contract will be signed for a time period of 10 (ten) years.

The selected bidder undertakes to provide a bank guarantee for the quality execution of the contract depending on the number of terminals for which it provides game content and full service and support, technical support on site (“onsite”), and provided spare parts for VLT appliances within 30 (thirty) days of signing this contract with validity of 3 (three) years and 14 (fourteen) days, with an obligation to renew it depending on the duration of the contract, in the manner and conditions defined in the contract.

For a served 1 (one) VLT device, the selected bidder is obliged to provide a 300 euro bank guarantee for quality performance of the contract which guarantee cannot exceed the amount greater than 250.000 euros.

The business associate has an obligation to renew the bank guarantee on every 3 (three) years, for the whole time being of the Contract.

If the Contracting Authority additionally orders VLT devices that exceed the number of devices that are provided by the already submitted bank guarantee from the selected bidder, then the selected bidder is obliged to submit an additional bank guarantee for the remaining number of VLT devices that he would serve with game content and full service and support, onsite technical support, and provided spare parts for VLT devices.

The business associate has an obligation to start up a procedure for the guarantee’s renewal in 1 (one) month the latest before the expiration of the active bank guarantee, and for that the National lottery is to be notified.

In case that the Business Associate fails to deliver the renewed bank guarantee for at least 14 (fourteen) days before the expiration of the active one, the National lottery has the right to compensate on the active bank guarantee and break the Contract off.

The State Lottery has the obligation to notify the Business Associate about the renewal of the bank guarantee within 2 months before its expiration.

The Contract for business cooperation is effective on the day of signing.

The condition for the validity of the Contract is securing a bank guarantee so that the named contract comes into force.

Transfer of the contract’s bond on a third party

The business associate holds the right to completely or partially (if the division of the contract fulfillment is possible), to transfer the contract to third parties, and in which case they will guarantee a quality fulfillment of the contract by the third party. That this transfer takes place it is necessary that the business associate indirectly issues an obligative written consent in agreement with the National lottery and approval by the abovementioned third party.

In case of the approach of a third person by the side of the business associate, a debt/confidence relationship only between the business associate and the third party will emerge. The business associate and the third party, responsible only for their and the third parties’ business, will be chosen as a Business Associate with whom the National lottery has signed a contract.

PATTENTED MATERIALS AND PROCESSES

The bidder will only secure the use of any patented design, material or process which will be used or delivered according to the Contract, with an appropriate legal Contract with the carrier or owner of the patent, and will have with them a copy of all the necessary contracts to the NL. The bidder is obligated to protect the rights of the SL which emerge from the use of such a patented design, material or process in accordance to the work which is to be completed according to Contract.

The designs, materials or processes which are patented, or allowed to emerge from the work of the bidder according to the Contract, the bidder keeps the rights to own, develop and commercialize these items.

The NL will be given the right to use the abovementioned items during the organization of games of chance according to the conditions agreed with the bidder, however, NL will not license, distribute or commercialize these items in any way.

CHANGE, SUBSTITUTION AND CANCELATION OF THE OFFER

The bidders can change, replace or cancel their offers after the delivery of the same, in the condition that the changes, replacements or cancellations are received by the National lottery before the due deadline for submission of offers established in point 6.

The changes, replacements or cancellations of the offers will be prepared, put into envelopes, marked and delivered in accordance with point 6, with the envelope to be appropriately sealed with the note “change”, ”replacement” or “cancellation”.

The offer can be changed, replaced or cancelled after the last deadline for the submission of offers, as is foreseen in point 6.

EXPLANATION, CHANGE AND COMPLEMENTATION OF THE PUBLIC PROCUREMENTS DOCUMENTATION

The bidder has the right to ask for an explanation about the public procurements’ documentation from The Committee for choosing, strictly in written form, at least 8 days before the final deadline for the delivery of offers.

The Committee appointed for choosing will deliver an explanation to all the juridical persons which have received a public procurements’ documentation, with what the juridical person who asks for this explanation will not be identified.

CANCELLATION OF THE PROCEDURE

The National lottery keeps its right to cancel the public call in any time during the process of delivery, from any given reason and for no reason at all. The National lottery is committed that this process will be a result during any contract made with any bidder.

The National lottery keeps the right to refuse any given offers or all offers, to announce new offers, to arrange a reception or independent completion and receiving of services and goods that are to be received after this, to cancel according to need of the usage of such goods, services or to cancel completely or partially from making a contract which it believes it does not serve the best interest of the National lottery.

LEGAL PROTECTION

Every bidder who has a legal interest in receiving a contract and who has suffered damage from the eventual breaking of the action for choice, has the right to ask for legal protection against the decisions, actions and negligence and take actions from the due organ in the procedure before the Board f directors of the State lottery, in compliance with the terms and actions foreseen with the National lottery’s acts.

The following elements must be contained in the complaint:

Data about the bearer of the complaint (name and surname, title of the bidder, address of living and place of business )
Data about the representative or authorized person;
Title and place of business of the National lottery;
Number and date of the public call for the allocation of an agreement for a business cooperation and data for the procurement documentation;
Number and date of the decision for the choosing of the most profitable offer, nullification of procedures and other decisions made by the National lottery;
Data concerning the actions or omissions for taking over actions by the National Lottery;
A description of the factual situation;
Description of irregularities and their explanation;
Suggestion of evidence;
A complaint claim and /or a request for compensation for the costs of the procedure and
Signature and seal of an authorized person.

The complaint is declared to the Board of directors of the National lottery. The complaint is delivered personally or through registered letter. The day of the delivery of the complaint through registered mail is considered as the day of submitting it. In case of submitting the complaint personally, the National lottery is requested to issue a receipt to the person who submits the complaint.

HOSTING AND LOOKING FOR DATA

The bidders are required to hold on to the legal and sublegal regulations of the Republic of North Macedonia. As such, it is requested from the bidder(s) to maintain a primary and additional object which will contain all the confidential information for the player. These kinds of confidential information will be included for the player or the client, but they are not limited to personal data (for example individual notes, personal identification or other specific information of the client) financial data (for example credit card information, banking accounts) or any other sensitive detailed information.

The location of the primary and additional hosting objects should be far enough away from one another in order that the system sustains maximal integrity.

TESTING OF COINCIDENCE

For every offered game which offers an element of luck, the Bidder will have to provide evidence for coincidence in the game.

THE CONTINUANCE OF THE DEFECT IN THE GAME

Every multi leveled game must be able to continue its ongoing playing way with all the actual characteristics of the game within a reasonable time frame after the defect of the game is removed, as is stated in the rules of the game. The actual payment of the deposit and all the credit which appears on the screen in front of the player before the defect must stay active or be returned to the player.

SAFETY FEATURES AND SOFTWARE CONTROL

The system must secure special features and functions to fulfill all the requests required for safe and efficient work.

TRANSACTION RECORD- KEEPING

All the activities for processing should be immediately recorded on more than one electronic appliance. The functions for an additional copy, renewal and excess will be supported with the usage of these record-keeping data books for a renewal, if possible. The process of recording transactions includes periodical control points.

SURVEYING OR RECORDING AN EVENT (GAME)

All the activities for processing the game, including the gaming process, winning events, other transactions linked to the game, conditions for mistakes and messages by the operational systems are recorded immediately, and this is the way this data is available for access by the NL. The bidder will introduce a 24/7 remote conditioned approach for the authorized employees of NL, for the goals of generating reference requests linked to players and transactions by the System of Internet games for following and control.

SYSTEM REVISION

The system can be revised for the proper use and getting rid of mistakes that could damage NL.

ONLINE CLOCK NOTIFICATION

The Internet slot system is supposed to maintain an inner clock which will tell the actual time accurately (in hours, minutes and seconds) also the date, which will be used to procure the following:

Timely printing of significant events;
Timely printing of reports;
Reference clock for notifications;
Timely printing of the changes in the configuration.

In case of more clocks being used, then there will be an appliance secured which will update all the clocks in the appliances set on the system, including the gaming appliances, at least once in every 24 hours.

UNIQUE TRANSACTION NUMBER

The method of giving the serial number which is to be used by the Bidder must take into consideration that the transactions can stay in the system for a longer period of time.

27.PROTECTED TRANSACTIONS

The system must be secure that the transactions cannot be manipulated. NL keeps the right to review all and/or narratives of the system, the lists of original programs and operational procedures in order to secure data and system integrity.

FOLLOWING OF GAME APPLICATIONS

The following or tracking of transactions must be done in real time. NL holds the right to receive regular reports on unusual operations taking place in the system as well as their source, such as problems in sale or cash, difficulties in communications, interruptions and the like.

NOTIFICATION

Authorized representatives of the NL can explore transactions and operations when it is necessary, for the standardized and ad-hoc reports. The data basis/ Systems register will include detailed notes for the transactions. The reports for the registry notes about transactions must allow standardized questions and selection, as well as a time print. All authorized employees of NL will be able to access these reports. These reports will be available through a secure distance approach.

SUPPORT SERVICES

The bidder will be asked to secure services for system support twenty four (24) hours a day to the NL.

OPERATIONAL SERVICES

The bidder will secure operations and services for tracking. These obligations include tracking of the system, generating reports, spare copies of data, tasks for starting and turning off the system, and various operational procedures for securing a proper functioning of the system, as well as system update.

TECHNICAL SUPPORT SERVICE

The bidder is obligated to fulfill the requests of the NL for technical support and changes in a timely and dedicated manner. With the offer, the bidder must prove that they are capable to deliver services and systems for the support of the software for the engineering of manipulating the system, the correction of the systems mistakes, changes in the work regulations and requests by the NL. Each support request and change out of the one agreed upon will be a subject of additional coordination and approval of and between parties.

USER DOCUMENTATION

Quick and referential guides are needed for the procedures to be correct. This documentation must contain the minimum of information and guides for receiving and usage of the reports, adjustments and other necessary documentation.

The bidder will update the material for training and every documentation for the user and player. The copies will be delivered to the NL two (2) weeks before the date of the beginning of any change whatsoever.

PROTECTION OF THE PARTICIPANTS IN THE GAMES OF CHANCE

The bidder is obligated to secure a chance of protection of the participants in the games of chance in accordance to the juridical regulations for a responsible organization of games of chance foreseen in the Law for games of chance and games of entertainment in the Republic of North Macedonia (Official newspaper of the Republic of Macedonia 24/11…251/22).

Based on the public call number 02-DL/2024/GC-S announced by the Joint stock company for organizing games of chance National Lottery of the Republic of Macedonia, for releasing a contract for business cooperation in terms of services and securing a lease of gaming contents and securing service and support for video lottery terminals, by administering a public call, is announcing the following:

II.5. We are in agreement to put this offer as the contracts’ subject for a business cooperation for service and securing a lease for gaming contents and securing the service and support of video lottery terminals or VLT machines TYPE 1, TYPE 2, TYPE 3.

A filled out form of the list of confidential information ( if there are no confidential information, the form does not have to be sent)
Documents for affirming the personal state implied in point 3.1.1 of the Public call;
Documents for affirming the technical or professional capability mentioned in point 3.1.2 of the public call;
Documents for affirming the systems of quality for which the bidder should be qualified, mentioned in point 3.1.3 in the Public call;
Statement for handling the subject in lease, mentioned in point 3.1.4 of the Public call;
Documents for the verification of the special conditions implied in point 4;
Statement of the bidder that if he is selected as the most favorable bidder, he will provide a bank guarantee for the quality fulfillment of the contract in the amount of the calculation according to the number of VLT devices.
A statement that under any grounds there are no unsettled debts towards the National lottery of the Republic of North Macedonia;
A technical offer with a detailed description of the software platform for services of securing a lease of a software and an on-line platform with gaming contents for the organization of games of chance;
A technical offer in which it is necessary to state the commercial names of all the offered gaming contents;
Statement for the seriousness of the bid and
A written authorization of the representative of the group of bidders (only for the group of bidders);

II.7. With this offer or bid we declare that the height of the payment for securing a full technical- technological support with the lease of gaming content for the network of video lottery terminals, as well as the service and support for these video lottery terminals, which is accounted as the lowest percentual amount of the difference between the payment and disbursements of the means of the participants in the game of chance, and after the deducted payment fees to the Republic of North Macedonia, which amounts to __%.

II.8. With the delivery of this offer or bid, we fully accept the terms conditions of the public announcement and the procurement documentation. We also do not deny your right of annulment of the procedure for procuring a contract for a business cooperation for services of leasing gaming contents and securing a service and support for video lottery terminals.

will not withdraw its offer before the expiration of its validity period,
will accept the correction of arithmetic errors by the commission,
will sign the business cooperation agreement in accordance with the terms of the public call, the tender documentation and the submitted offer or
will provide the guarantee for high-quality and timely execution of the contract, if the contracting authority has foreseen it in the public call.
