Court Declares illegal Advertising of Betting Houses During Hours of Protection for Minors
The courts have backed the CNTV ruling that declares commercials from these controversial platforms illegal, as they affect the education of children and adolescents.
CHIILE (July 12, 2024) — Betting house advertisements have invaded not only cable TV sports channels, but also free-to-air television. Through event sponsorships and using faces and influencers, they have motivated many people to enter the world of sports predictions with a clear danger: gambling addiction.
The Santiago Court of Appeals has upheld the decision of the National Television Council (CNTV) to declare such advertisements illegal during the hours of protection for minors, between 6:00 a.m. and 10:00 p.m.
According to Bio-Bio Chile , the courts have upheld the ruling by the Providencia agency, which establishes that broadcasting commercials linked to these types of portals, which many YouTubers have revealed do not even pay taxes in Chile but in tax havens, outside of adult hours constitutes a violation of Law 18,838.
This indicates that the broadcasting of these advertisements may affect the education of children and adolescents (NNA) since it “promotes gambling activities related to games of chance, which constitute an illegal activity that is criminally punishable.”
Furthermore, the court accepted the CNTV’s request on two points: that the activity of these betting houses is illegal as it is not taxed in our country, and that the broadcasting of these spots at times suitable for all audiences is contrary to the spiritual formation of children and youth.
