Dutch Gaming Authority Issues Warning Regarding Violation of Ban on Untargeted Advertising on TV
Sponsoring
The advertisement in question showed footballers in uniform, including a footballer in a sports uniform with the name of the provider depicted on it. The advertisement was shown on both television and social media. Although the advertisement was not for the gambling provider itself, gambling providers are at all times responsible for expressions of their brand, even if they are shown by third parties with whom they have a sponsorship agreement. In sports sponsorship, it is important that there is a direct relationship between the mention of the provider, the practice of the sport and the place where the sport is practiced (for example a football stadium). This was not the case in the television advertisement.
Because the provider has taken measures to prevent a recurrence of the violation, the Ksa will issue a warning.
Untargeted advertising
Since July 2023, it has been prohibited to make non-targeted advertising for online gambling and since 1 July 2024 for programme and event sponsorship. This means that advertising for online gambling in public spaces and on radio and TV is prohibited, because it is impossible to exclude vulnerable target groups, such as young adults, with this form of advertising.
