Instruction for Holland Casino for Insufficient Compliance with Wwft

THE HAGUE, Netherlands (July 29, 2024) — In 2019, the Netherlands Gambling Authority (Ksa) issued an instruction to Holland Casino because it was not properly complying with certain provisions of the Money Laundering and Terrorist Financing (Prevention) Act (Wwft). Investigations by the Ksa showed that Holland Casino was, among other things, insufficiently monitoring the gaming behaviour of players and the origin of the money used. According to the Wwft, this is required. The Netherlands Gambling Authority (Ksa) therefore issued an instruction at the time with the task of getting compliance with the Wwft in order. Holland Casino complied with all the given guidelines within the deadlines set at the time.
When publishing the designation and the decision on the objection, account was taken of the ruling of the Trade and Industry Appeals Tribunal of 26 March 2024 ( U). With the ruling of the CBb, the designation is irrevocable and is therefore made public. In addition to the designation, the decision on the objection that was directed against the designation is also made public. Now that the appeal of Holland Casino has been partly declared well-founded by the CBb, this has led to an adjustment of the designation to be made public and of the decision on the objection taken thereon, in the sense that parts of it that the declaration of well-foundedness of the appeal relates to are not made public. The decision to make public itself is not made public, because it falls under the confidentiality obligation of the Wwft.

The publication of this instruction is important for several reasons:

  • This allows the general public to become aware of the Ksa’s (enforcement) actions and the reasons for them
  • In this way, other providers can become aware of behavior that could lead to enforcement
  • It can discourage other providers from violating the Wwft; it has a preventive effect
