KSA: Reflection Policy Rule Responsible Gaming with Technical Consultation

THE HAGUE (November 7, 2024) — The Netherlands Gambling Authority (Ksa) held a reflection with online providers a few months after the Responsible Gaming Policy Rule came into effect. During a technical consultation organised by the Ksa, the supervisor once again emphasised the importance of a professional attitude among providers and further explanation was given of the amended Policy Rule. It was the first time that the Ksa organised such a consultation.

In conversation with the online providers

The amended Responsible Gaming Policy further elaborates on a number of the legal provisions regarding the duty of care of providers. Because players must be well protected against addiction and excessive gaming behaviour, it is important that the duty of care is complied with as well as possible by providers. That is why the Ksa organised this meeting, where providers could ask questions and make comments about the issues they are facing now that the policy has come into effect. The need for this quickly became apparent from the reactions of those present. The Ksa first emphasised that it expects providers to have an honest, professional and expert attitude to work and that they themselves must ensure a responsible, reliable and verifiable organisation and safe gaming environment.

During the consultation, the Ksa provided more explanation about the topics that were discussed in the questions submitted in advance, in order to create more clarity for the providers. Because not all providers were present at the consultation, the Ksa aims to make the discussed information available to the market on its website in the short term. Attention will also be paid to relevant new questions that emerged during the consultation.

Amended Responsible Gaming Policy

With the amended Responsible Gaming Policy, the Ksa is taking a major step towards realising a safer online gambling market. Important adjustments and clarifications include the obligation for ‘real-time monitoring’ and the setting of a financial deposit limit. This is the result of Ksa research among providers into the fulfilment and implementation of the duty of care. The changes to the advertising rules have also been incorporated into the policy, following the recently amended legislation in this area (2022-2023). The amended policy entered into force on 3 June of this year. An exception was made for new provisions that required major IT adjustments at online providers. There was more preparation time for these provisions. The policy entered into full force on 1 October 2024.
